‘Is This a Felony?' Asked Man Accused of Masturbating Near East Oak Cliff Daycare, Police Say

A Terrell man arrested on suspicion of exposing himself to a daycare full of children asked Dallas police if he'd be charged with a felony, officials wrote in an arrest-warrant affidavit.John Marvin Battle, 56, was charged with indecency with a child by exposure Saturday and remained in the Dallas County jail Monday afternoon.Two Charisma Bundle of Joy Child Care Center employees told police that a man had pulled down his pants and masturbated for about 15 minutes outside the building on Lancaster Road and Kiest Boulevard around 7:15 p.m.A 10-year-old girl also saw the man, according to the affidavit, and another child told police, "I saw him naked!"The man fled south before police arrived, but officers found Battle, who matched the witnesses' descriptions, walking back toward the daycare.Battle told police he was "just laying down" behind the building, according to the affidavit. When police called a detective, Battle asked how many children were present and whether the charge was a felony.He has pleaded guilty to six counts of criminal trespass in Dallas County.
