Appeals Court Won't Reconsider Ruling

A federal appeals court has refused to reconsider a recent decision that upheld the use of race in University of Texas undergraduate admissions.

Abigail Fisher's attorneys had asked the full 5th U.S. Circuit Court of Appeals to overturn a three-judge panel's previous ruling in July. That 2-1 ruling held that barring the university's "limited use of race" would hurt diversity on the Austin campus.

The New Orleans-based court denied Fisher's request Wednesday.

Fisher, who is white, sued the university in 2008 after she was denied admission. The case went to the U.S. Supreme Court last year, but justices voted 7-1 to tell the lower appeals court to re-examine Fisher's arguments.

Fisher's attorneys say they will appeal again to the U.S. Supreme Court.
