East Dallas Apartments Can Resume Construction as Legal Fight With Neighbors, City Continues

Work will soon resume on an under-construction East Dallas apartment complex that has been mired in messy legal battles with a neighborhood group and City Hall over a height-based zoning restriction.The courts and the city have allowed developer Encore Multi-Family LLC to continue to build the 253-unit complex after posting a $150,000 bond, which is meant to enforce a judgment if the Peak's Suburban Addition Homeowners Association ultimately wins on appeal. And if the association does win, that could mean full or partial demolition of the complex.Mike Northrup, an attorney for the association, said he is weighing the next move, which might be a review of the bond amount."It's very light, and the basis for the court having come up with that number — I don't get it," Northrup said.  Continue reading...
