A grocery store employee who spent nearly 25 years in prison for killing his wife is set to go free after DNA tests showed another man was responsible.
Michael Morton was to appear in court in Georgetown, north of Austin, on Tuesday, then be released. Prosecutors have agreed that all charges against the 57-year-old should be overturned.
Morton was convicted on circumstantial evidence of bludgeoning his wife Christine to death in 1986.
Morton said he left for work at 5:30 a.m. that day and that an intruder was responsible.
Tests that weren't available during Morton's original trial show a bloody bandanna found near their home contained the victim's DNA but also that of another man linked to a similar 1987 slaying in the area.
Authorities haven't identified that man.
