Texas Comptroller Says No State Cash for Ex-Death Row Inmate

The state comptroller says a man freed from death row after his conviction for killing a Houston police officer was overturned by an appeals court isn't eligible for nearly $2 million in compensation from a state fund for exonerated inmates.

Comptroller Glenn Hegar said Alfred Dewayne Brown hasn't been formally found actually innocent of the 2003 shooting death of Officer Charles Clark, so he doesn't qualify for the payout.

The 34-year-old Brown spent 12 years locked up for a killing he said he didn't do.

Harris County prosecutors have said they don't have enough credible evidence to retry Brown and the murder charges have been dismissed.

Brown's lawyer, Neal Manne, told the Houston Chronicle he'll appeal Hegar's decision and, if necessary, take his arguments to court.
