Re-Trial in DFW Disc Jockey Sex Assault Case Delayed

Officials have not said when the case will return to court

The second sexual assault trial for a North Texas disc jockey that was to begin this week has been delayed, NBC 5 has confirmed.

According to Dallas County Court records, the new trial for Anthony Salvatori — accused of rape and indecency with a child in 1999 — was set to start Monday at 9 a.m., but was delayed.

No further details about the delay have yet been released.

The alleged incident happened in 1999, when the victim said she was trying to win tickets to an N’Sync concert from Salvatori’s previous employer, KISS-FM.

The victim testified in the first trial that she was inappropriately touched at the radio station and Salvatori — who went by the name Tony Marino on the air — later took her to his apartment where she said she was raped.

Salvatori denies any sex took place, but did admit in court to kissing the then 14-year-old when he was 27 and that some “heavy petting” took place.

The victim didn’t come forward until 2010, 11 years after the crime. Since there is no statute of limitations for felony sexual assault, Dallas police investigated before the district attorney’s office decided to prosecute.

The first trial ended in a mistrial in May 2014 when the jury could not reach a unanimous decision.

There is also a civil lawsuit filed in Dallas County connected to the sexual assault charges.

Salvatori and KISS-FM’s owners are named defendants in that lawsuit. Court documents show testimony could begin in that case in August.

Salvatori currently uses the name Tony Lopez as an afternoon disc jockey for Christian radio station KLTY.
