A judge is expected to decide what evidence to have tested for DNA ahead of the trial of the man charged with killing famed Navy SEAL sniper Chris Kyle.
State District Judge Jason Cashon has set a 10 a.m. Tuesday hearing in the case of Eddie Ray Routh. The 26-year-old Routh is charged with capital murder for the deaths of Chris Kyle and his friend, Chad Littlefield.
Attorneys for both sides say in a court filing that they've agreed to DNA testing for some pieces of evidence, but not others.
Routh's attorneys have indicated they will make an insanity defense. His trial is scheduled for May.
Kyle is reputed to be the deadliest sniper in American history and the best-selling author of the memoir "American Sniper."
