Walmart has filed a lawsuit against the Texas Alcoholic Beverage Commission challenging a state law that prohibits publicly traded companies from selling liquor in the state.
Walmart filed the complaint in an Austin federal court on Thursday.
Texas law prohibits publicly traded companies from owning or holding a package store permit.
Walmart is also challenging a loophole in the law that it says “irrationally prohibits” retailers from holding more than five package store permits.
