Pregnant, Brain-Dead Woman's Lawsuit Rebutted

Attorneys for the North Texas hospital keeping a pregnant, brain-dead woman have denied allegations of a lawsuit seeking to remove her from life support.

The Tarrant County District Attorney's office filed papers on behalf of John Peter Smith Hospital on Friday, denying allegations made by Erick Munoz.

He sued the Fort Worth hospital on Tuesday, demanding that wife Marlise Munoz be removed from life support. She lost consciousness in November, and attorneys have said medical records confirm she's brain-dead.

Hospital officials contend Texas law prohibits removal from life support because she's pregnant. The fetus is believed to be at about 21 weeks' gestation.

No hearing is scheduled, but the case was assigned to state District Judge R.H. Wallace after the previous judge recused herself.
