Midland Officer Not Indicted in Fatal Shooting

A grand jury has declined to indict a West Texas police officer who was off-duty when he fatally shot a robbery suspect at a restaurant.

Midland police on Thursday announced Detective James Cox has returned to work.

Cox on June 27 was eating at a Mexican restaurant in Midland when a man walked in a back door, fired several shots in the kitchen and tried to rob the place.

Investigators say Cox confronted the fleeing suspect, 35-year-old Nyocomus Garnett, who refused to surrender. Cox fatally shot Garnett when the suspect pointed a gun at him.

Cox was put on paid administrative leave following the incident. He was no-billed by a grand jury in late July.
