Evidence in Tarrant Co. Judge's DWI Case Tossed

The judge in driving-while-intoxicated case against a Fort Worth judge suppressed evidence in the case Thursday.

Judge Elizabeth Berry was arrested on suspicion of DFW in Alvarado in November.

Her attorney argued the blood alcohol test done at the Johnson County Jail wasn't done in a sanitary location as required by law.

Retired Senior Judge Robert Dohoney agreed and ruled prosecutors can not use the blood test as evidence.
