Case of Man Who Died After Killing Pastor Closed

A grand jury has declined to issue indictments in the case of a man who died in police custody after he fatally beat a North Texas pastor in his church.

Tarrant County prosecutor Jack Strickland says the case was presented Tuesday because it involved officers who'd been cleared in independent investigations.
 
Derrick Birdow drove his car into a Forest Hill church in October, then beat the Rev. Danny Kirk Sr. to death with an electric guitar. 
 
Forest Hill officers subdued Birdow with a stun gun, handcuffed him and put him in a patrol car, where he later was found dead. 
 
The medical examiner ruled that Birdow died from taking the hallucinogenic drug PCP and said the stun gun did not contribute to his death in the Fort Worth suburb.
