Man Accused Of Slaying Car Salesman During Test Drive

Police believe John Phinney was shoved out of moving truck

A man was arrested in Lewisville Tuesday night on capital murder charges after a car salesman fell out of a moving truck during a test drive, Richardson police said.

Witnesses told police that John Phinney, 53, fell out of a moving truck along U.S. Highway 75 near the Spring Valley exit at about 5:30 p.m. Tuesday.  It was unclear whether Phinney was pushed from the truck, which was probably traveling more than 50 mph, police said.

James Allen Thorpe, 41, was arrested in connection with Phinney's death.

Officers said Phinney worked for the Manuel Dodge dealership in Richardson and had gone with the man on a test drive.

Thorpe was being held Wednesday on a $3 million bond at a Dallas County jail.

Thorpe denied pushing Phinney out of the vehicle in a jailhouse interview.  He said the car salesman jumped out of the vehicle.

 Police said they were contacted after Phinney didn't return from the test drive.
