A prosecutor for a Houston-area county has been accused of professional misconduct in a drug possession case later dismissed.
The State Bar of Texas could reprimand Fort Bend County District Attorney John Healey Jr.
Assistant DA Mark Hanna has also been accused of professional misconduct by Jacob Estrada, whose conviction was thrown out last June.
Healey, on behalf of himself and Hanna, didn't immediately return a message for comment Thursday. Healey told KHOU-TV that he expects vindication.
Estrada in 2006 was arrested in a drug case. He pleaded guilty, based on lab results, and received eight years in prison. A lab worker was later fired for fabricating evidence.
The disciplinary petition filed Tuesday says Healey delayed notifying Estrada of the firing or that evidence in his case was destroyed.
