Texas Teacher Acquitted of Injury to Child

A Southeast Texas teacher has been acquitted of injuring an 11-year-old boy who testified he kicked her during classroom scuffles.

A jury in Beaumont on Wednesday found 63-year-old Ruby Gunner not guilty of injury to a child. Gunner didn't testify in the trial over facial scratches the boy suffered last April at Robert E. Lee Elementary School in Port Arthur.

The boy testified he tried to shove past Gunner and leave class and she used her hands to try to stop him. The child says Gunner hit him in the face, he kicked her and he ran to a counselor's office.

The boy says Gunner later confronted him in another classroom, he kicked her in the stomach and they scuffled.

School officials cite student safety and plan to fire Gunner.
