Students Kicked Out of School for Truancy File Complaint

Disabled students who were charged with truancy and kicked out of school have accused 13 school districts and the Texas Education Agency of violating federal law.

Three nonprofits filed the complaint Wednesday with the education agency, but are seeking an outside investigator.

They accuse the agency and districts, including those in Austin, Houston and San Antonio, of violating the Individuals with Disabilities Education Act.

The districts are accused of failing to give students with disabilities individualized education services.

Between 2010 and 2013, about 1,200 students with disabilities failed GED tests they were ordered by courts to take after being charged with truancy, a criminal offense.

The groups filed a 2013 complaint triggering a U.S. Department of Justice civil rights investigation into whether Dallas County schools were too harsh on truants.
