The special prosecutor leading the felony case against Gov. Rick Perry says he shouldn't be compelled to produce transcripts of testimony before the grand jury.
In filings released by the court Monday, Michael McCrum said Perry's attorneys lack legal standing to request transcriptions of testimony grand jurors heard in secret.
McCrum also said the case shouldn't be dismissed on technicalities, including whether he was properly sworn in as special prosecutor.
The grand jury in August indicted Perry on charges of abuse of official power and coercion of a public servant, relating to his veto of funding for public corruption prosecutors.
Perry's asking Judge Bert Richardson to quash the case on the technicalities, while also seeking the transcriptions.
Perry's first court appearance is Thursday, when Richardson should rule on both requests.
