Fort Worth to Sue Two Retired Firefighters Over Overpayment

The city of Fort Worth mistakenly overpaid two firefighters more than $92,000 when they retired four years ago and now plans to file lawsuits to get the money back.

Firefighters Fernando Gonzalez and Kenneth Nealy retired in August 2013.

"A mistake was made in calculating their benefits," city staffers wrote in briefing papers for the Fort Worth City Council.

The city overpaid Gonzalez $63,725 and Nealy $28,742, the city said.

The city has tried to recover the money and even offered payment plans but says that both men have refused, according to the briefing document.

The city council is set to approve filing the lawsuits Tuesday. They are on the "consent" agenda, reserved for non-controversial items that are almost always approved.

Gonzalez and Nealy could not be reached for comment.
