State investigators are reviewing a Fort Worth bar that may have served a wrong-way driver in a crash that killed a fuel truck driver early Monday morning, source say.
Luis Nieves, 23, is charged with drunken-driving and intoxication manslaughter. Police say hit a tanker truck on Interstate 30, killing 45-year-old Alejandro Raya, a married father of three children.
Sources close to the investigation say that Embargo is the subject of a Texas Alcoholic Beverage Commission investigation. Embargo is located at 210 E. Eighth St., a block from the Convention Center.
Nieves told WFAA-TV in a jailhouse interview that he had 10 beers at a bar near the Convention Center before the wreck.
TABC Capt. Charlie Cloud declined to discuss the Nieves case but spoke about drunken-driving cases in general.
"Our concern is always going to be, 'Was somebody negligent in the service of that alcohol? Is there a retailer out there that's over-serving?'" he said.
Cloud said bartenders and servers can face misdemeanor criminal charges for serving alcohol to intoxicated customers and the bar's license can be suspended or revoked.
An employee at Embargo who did not know about Nieves said Wednesday afternoon that customers often come in after drinking at other bars, so it can be difficult to know how much a customer has consumed.
That employee took a message for the Embargo owner, who did not call back Wednesday.
Cloud said TABC investigators develop a timeline in such cases to determine where and how much a person was served.
"If somebody is served 10 beers in a fairly short period of time, well, come on," he said. "Common sense comes into play here."
