Dallas Man Has Date With Death Tonight

The U.S. Supreme Court is being asked to block tonight's scheduled execution of Texas convicted killer John Alba.

Alba was condemned over the 1991 killing of his estranged wife, Wendy.

Investigators say Alba located his spouse at an apartment in Allen, as she tried to evade him -- and shot her.

Alba would be the 11th condemned prisoner executed this year in Texas.

Trial testimony indicated Alba and his wife had a rocky marriage marked by alcohol abuse and infidelity and repeated visits from police responding to calls of domestic violence.

At the time of the shooting, Alba had just posted bond after he was jailed on a charge of molesting a 12-year-old girl.

The Texas Court of Criminal Appeals has rejected his request for a reprieve. The Texas Board of Pardons and Paroles denied a clemency request.
