Man Shot by Off-Duty Officer Near Forney: Authorities

Police in Kaufman County, Texas, said a man was sent to the hospital after being shot five times by an off-duty officer Sunday evening.

Investigators said the off-duty officer shot the man multiple times just outside Forney city limits on Farm-to-Market Road 741 around 9 p.m. Police haven't released details of the shooting but said the off-duty officer, who has not been publicly identified, was uninjured.

Benny Wesberry, who identified himself as the victim's father, said the shooting was unnecessary. Wesberry told NBC DFW he was trying to calm his son, who had been drinking and was agitated.

"I had control of him. I was pulling him backward," he said. "I already had him under control."

Wesberry said a pickup truck pulled up and parked near them. The driver identified himself as an off-duty Forney police officer, according to Wesberry.

Wesberry said his son became more agitated when the officer did not leave. He allegedly ran toward the truck and began pounding on the driver's side window, telling the man to leave.

"I had pulled him back away from the vehicle, before the guy kicks open the door and fires rounds into him," Wesberry recalled. "And if any of the bullets actually passed through my son, they would hit me."

Wesberry said the officer began to taunt his injured son, then drove off, only to return once other investigators had arrived.

Wesberry's son was flown by CareFlight to Methodist Dallas Medical Center in unknown condition, officials said.

Investigators focused on two vehicles left at the intersection of Farm-to-Market roads 741 and 2932, according to police. Police said they closed FM 741 from Interstate 20 to Precinct Road while they investigated the shooting.
